3. Scheduling
We aim to keep your scheduled date, but heavy rain, red dirt conditions, or safety issues may shift the time or day. We will send updates by SMS or phone if we need to delay due to wet soil conditions that prevents equipment access.
4. Payments
- Payment is due as stated in your invoice.
- Late or missed payments may lead to added fees.
- Failure to pay may result in work being paused or cancelled.
- For large excavation projects, a deposit may be required before work begins.

You are responsible for:
Ensuring Access: Gates and driveways must be wide enough for heavy machinery (excavators/trucks) to enter safely.
Marking Utilities: You must inform us of any private water lines, septic tanks, or underground cables before we dig.
Clearance: Keeping pets, children, and vehicles clear of the work zone during service.
Accuracy: Providing accurate property lines and boundary information.
If access is blocked or unsafe for our equipment, we may reschedule and charge a mobilization fee.
7. Work Conditions and Safety
We may pause or reschedule work for weather, unsafe slope conditions, or equipment issues. We reserve the right to refuse work if it creates safety risks for our operator or equipment.
8. Property Damage & Underground Hazards
We take extreme care when operating heavy machinery.
Hidden Hazards: We are not responsible for damage to unmarked underground pipes, wires, sprinklers, or septic systems.
Pre-Existing Conditions: We are not responsible for damage caused by pre-existing rot, drainage issues, or unstable soil.
Our Responsibility: If our operator causes clear, avoidable damage to marked structures, we will work with you to make it right.
9. Cancellations
If you need to cancel or change your appointment, please contact us as soon as possible. Same-day cancellations may lead to a fee to cover fuel and lost time.
10. Photos and Media
We may take before and after photos of work areas for records, training, and marketing. We will not post photos that show your face, license plates, or specific house numbers without your consent.
11. Liability
Kyani Equipment Services is not responsible for:
-Delays caused by weather (rain/floods) or conditions outside our control.
-Natural settling of soil after grading or excavation.
-Injury or damage caused by entering the work zone while equipment is operating.
